End User License Agreement

This End User License Agreement (“Agreement”) is between you and PHI Decks (“PHI Decks,” “we,” “us”), a residential deck builder based in Plymouth, Minnesota, and governs your use of the PHI Decks Portal at portal.phidecks.com (the “Portal”). By signing in or using the Portal you accept this Agreement. If you are using the Portal as a PHI Decks customer, it supplements — and does not replace — your construction contract with us; if the two conflict, the construction contract controls for the construction work.

We grant you a personal, non-exclusive, non-transferable, revocable license to use the Portal to follow and manage your PHI Decks project: viewing project information and documents, exchanging messages with our team, uploading project-related files, reviewing invoices, and managing your notification preferences. The Portal is provided for this purpose only and not for resale or use on behalf of anyone who is not a party to a PHI Decks project.

Accounts are created by PHI Decks for its customers and team; there is no public registration. You are responsible for keeping your sign-in method secure — the email account that receives your sign-in links, or your password — and for what happens under your account. Tell us promptly at tim@phidecks.com if you believe your account has been accessed without your permission.

You keep ownership of the messages, photos and files you submit. You grant PHI Decks a license to store, display and use them for delivering your project and operating the Portal — for example showing your uploaded color selection to your project manager, or including crew photos in your weekly update. You are responsible for having the rights to what you upload, and you agree not to upload content that is unlawful, infringing, or malicious (including malware).

You agree not to: attempt to access another customer’s project or any data not intended for you; probe, disable or overload the Portal or its security measures; use automated tools to scrape the Portal; misrepresent who you are; or use the Portal for anything unlawful. We may suspend or terminate access that violates this Agreement.

The Portal presents project information — schedules, status, weekly updates, documents and invoice summaries — as a convenience. Schedules and estimated completion dates are good-faith projections, not promises. Invoice figures shown in the Portal come from our accounting system; the authoritative record is the invoice itself. Payments are made through our payment provider’s own site, not in the Portal, and document signing happens through our e-signature provider. Weekly updates are drafted with an AI writing tool from crew logs and reviewed by your project manager before publishing.

The Portal, including its software, design and branding, belongs to PHI Decks and its licensors. This Agreement gives you no rights to copy, modify, distribute, or reverse-engineer it beyond what the license above allows or applicable law permits.

The Portal is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose and non-infringement with respect to the Portal itself, and we are not liable for indirect, incidental, special or consequential damages arising from Portal use, or for outages of the third-party services it depends on. Our total liability arising out of Portal use is limited to one hundred U.S. dollars ($100). Nothing in this section limits any right or warranty in your construction contract with us, or any liability that cannot be limited by law.

This Agreement applies while you use the Portal. We may suspend or end Portal access for violation of this Agreement, and we may retire Portal accounts after a project concludes. Ending Portal access does not affect your construction contract, and sections that by their nature should survive (your content license for records we retain, disclaimers, limits) survive.

This Agreement is governed by the laws of the State of Minnesota, and disputes belong in the state or federal courts located in Hennepin County, Minnesota. If we update this Agreement we will note the new date above and, for significant changes, email account holders; continued use after a change means the updated Agreement applies. If part of this Agreement is found unenforceable, the rest stands.
